These Terms of Service ("Terms") govern your access to and use of the Dagen Media podcast production application (the "Service") operated by Dagen Media ("we", "our", "us"). By using the Service, you agree to these Terms.

1. Eligibility & Accounts

The Service is intended for authorized users of Dagen Media and its client organizations. You are responsible for maintaining the security of your account and all activity that occurs under it.

2. Acceptable Use

Do not use the Service to violate any law or third-party right.
Do not attempt to access data that does not belong to your organization.
Do not send unsolicited or deceptive email through connected accounts.
Do not reverse engineer, interfere with, or disrupt the Service.

3. Connected Google Accounts

When you connect a Google/Gmail account to a podcast, you authorize the Service to send email from that account on your behalf. You may revoke this access at any time. You are responsible for ensuring the connected account's use complies with Google's terms.

4. AI-Generated Content

The Service uses AI to assist with show notes and other content. AI-generated output may contain errors. You are responsible for reviewing and approving content before it is sent to guests or published.

5. Your Content

You retain all rights to the content you upload or generate through the Service. You grant us a limited license to host, process, and transmit that content solely to provide the Service.

6. Service Availability

We strive to keep the Service available but do not guarantee uninterrupted operation. We may modify, suspend, or discontinue features at any time.

7. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAGEN MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9. Termination

We may suspend or terminate access to the Service at any time for violation of these Terms or for any other reason at our discretion.

10. Changes

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
